• AI Tools: AI-powered content generation, data analysis, campaign optimization, lead scoring, and automated recommendations.
• Communications Services: Integrated phone calling, SMS messaging, email communications, appointment scheduling, webinar hosting, and notification systems.

3. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Services to transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, or objectionable content.

7. AI-Generated Content Disclaimer

CreativeWolf utilizes artificial intelligence and machine learning technologies as part of its Services. AI-generated content, recommendations, and outputs are provided as tools to assist users and may require human review before use.

CreativeWolf does not guarantee the accuracy, reliability, completeness, or suitability of any AI-generated content for any particular purpose. Users are solely responsible for reviewing, approving, and assuming liability for any AI-generated content before publishing, distributing, or acting upon it.

AI systems may produce results that are incorrect, biased, or inappropriate. CreativeWolf disclaims all liability for damages arising from the use or reliance on AI-generated content.

8. Communications Consent

By providing your contact information and using our Services, you consent to receive communications from CreativeWolf through various channels, including:

When you opt in to receive SMS messages from CreativeWolf, the following terms apply:

• Program Description: You may receive text messages related to appointment reminders, follow-up communications, marketing updates, service notifications, and promotional offers.
• Message Frequency: Message frequency varies depending on your interaction with our services and the programs you have subscribed to.
• Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
• Opt-Out: To stop receiving messages, reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message. You will receive a confirmation message and no further messages will be sent.

• Carrier Liability: Carriers are not liable for delayed or undelivered messages. CreativeWolf is not responsible for messages that are not delivered due to carrier issues, device incompatibility, or other factors beyond our control.

Third-party integrations available through our platform (including but not limited to telephony providers, email delivery services, analytics platforms, and payment processors) are provided on an "as is" basis. We do not warrant the availability, accuracy, or reliability of any third-party services.

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our Services, you consent to the data practices described in our Privacy Policy.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIVEWOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO CREATIVEWOLF IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless CreativeWolf, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.

You may terminate your use of the Services at any time by discontinuing use and contacting us to close your account.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and may provide additional notice through our Services or via email. Your continued use of the Services after the posting of revised Terms constitutes your acceptance of the changes.
